NEW AND PROPOSED AMENDMENTS TO LOCAL FORMS
Under Federal Rule of Bankruptcy Procedure 9009, if an Official Form for use in a case or proceeding has been prescribed by the Judicial Conference of the United States, that Official Form must be used without alteration—unless alteration is authorized by the Federal Rules of Bankruptcy Procedure, the form itself, or the national instructions for a particular form. Where no Official Form has been prescribed by the Judicial Conference of the United States, under its authority to make and amend rules governing practice and procedure under 28 U.S.C. § 2071, Federal Rule of Bankruptcy Procedure 9029(a)(2), and Rule 87.1 of the Local Rules of the United States District Court for the Southern District of Florida, this Court has promulgated its own local forms for use in cases and proceedings pending in this Court. Under Local Rule 9009-1, unless the Court orders otherwise, if the Court has promulgated a local form, that local form must be used without material alteration unless alteration is authorized by these rules or the form itself.
