Obtaining Transcript or Audio Recording of Court Proceedings

 

Effective August 1, 2015, the U.S. Bankruptcy Court for the Southern District of Florida has adopted the use of digital audio recording (DAR) for all court proceedings in all divisions. The courtroom technology selected is ForTheRecord® (FTR).

Please contact one of the court authorized transcription services listed below. You will be advised as to procedures and costs pertaining to your request. The service will ask you to provide: case name and number, name of the presiding judge, the date of the hearing and the turn-around time (click here for chart). Please note that the Court makes no recommendation as to which service provider to choose.

Requests for Transcripts and/or Audio Recordings

TRANSCRIPT

All requests for transcripts must be submitted on NEW Local Form “Transcript Request Form.”    Requests for transcripts will not be accepted in the courtroom or in the clerk’s office. The completed form must be submitted directly to the court authorized transcription service by email, fax or U.S. mail. A separate form must be submitted for each hearing transcript being requested. Prior to requesting a transcript, it is the responsibility of the requesting party to verify that the transcript has not already been filed with the court.

REVIEWING A TRANSCRIPT

In accordance with the policy established by the Judicial Conference of the United States:

  1. A transcript provided to the Court will be available at the Clerk’s Office for inspection only for a period of 90 days after it is delivered to the Clerk.
  2. During the 90-day period, a copy of the transcript may be obtained from the transcriber at the rate established by the Judicial Conference, and an attorney who obtains the transcript from the transcriber may obtain remote electronic access to the transcript through the Court’s CM/ECF system.
  3. After the 90-day period has ended, the filed transcript (or redacted transcript) will be available for public viewing and for downloading from the Court’s CM/ECF system through the judiciary’s PACER system.

Additionally, there are requirements for parties to review the transcript for privacy related matters. Please review the court’s Local Rule 5005-1(A)(2)(b), for details about the procedures to be followed.

 

COMPACT DISC (CD)

A request for a compact disc (CD) containing an audio recording of a proceeding held on or after August 1, 2015, can be purchased at a cost of $30.00 for each hearing requested. All requests must be submitted on NEW Local Form “Request for Compact Disc (CD) of Audio Recording of Court Proceeding.”   Requests will not be accepted in the courtroom. The completed form must be submitted at any clerk’s office location or by U.S. mail or email to: Audio_Recording_Request@flsb.uscourts.gov. A CD of audio recordings will be available within two business days following receipt of the request. The clerk’s office will contact you when the CD is ready for pickup. The CD will not be released to the ordering party until payment is made via cash or check made payable to Clerk, U.S. Court. If you request the CD be mailed, you must provide the clerk’s office with a padded, self-addressed stamped envelope along with the required fee. A separate request form must be completed for each hearing requested.
